b'(3B)A local authority in Wales may supply goods and services to any authority in Wales or other person (other than a governing body within subsection (1)) for the purpose of assisting them in making for a child any special educational provision which any learning difficulty of the child calls for. (4)This section is without prejudice to the generality of any other power of local authorities to supply goods or services. Section 450 of the 1996 Act states charges cannot be made for admission to a maintained school. Section 451 prohibits charging in respect of the education provided for registered pupils at any such establishment during school hours. There are exceptions including individual tuition, the playing of any musical instrument and provision for cases where education is provided partly during and partly outside school hours. Section 453 deals with examinations and prohibits charges but permits in some cases the recovery of wasted fees. No charge shall be made in respect of the entry of a registered pupil at a maintained school for a prescribed public examination in any syllabus for that examination for which the pupil has been prepared at the school. Despite the above, where: (a)the governing body of a maintained school or the [local authority] have paid or are liable to pay a fee in respect of the entry of a registered pupil at the school for a public examination in any syllabus for that examination; and (b)the pupil fails without good reason to meet any examination requirement for that syllabus, that body or authority may recover the amount of the fee from the pupils parent. It shall be for the body or authority which has paid or is liable to pay the fee in question to determine for the purposes of this section any question whether a pupil who has failed to meet an examination requirement had good reason for the failure. Sections 455 and 456 of the 1996 Act set out the permitted charges a local authority may make on the parents of pupils who wish to pursue activities taken as optional extras, such as tuition for the playing of any musical instrument. These costs may also include costs incurred in respect of materials, books, instruments or other equipment used for the purposes of or in connection with the provision of the optional extra, the provision of non-teaching staff and any tuition in connection with the optional extra. This also allows an authority to levy fees for board and lodging to pupils on residential trips. Section 457 of the 1996 Act requires governing bodies of maintained schools and every local authority to determine and keep under review the classes or descriptions of cases in which they propose to make charges for any optional extra or board and lodging in respect of which charges are permitted by the Act. Section 458 makes further provision with regard to charges for board and lodging at boarding schools. Section 460 of the 1996 Act also makes further general and supplementary provisions relating to charges. 109'
