Any Review of a Premises Licence is the most severe enforcement action that can be taken where any of the Licensing Objectives are being undermined by the way the Premises are being operated or where there is an association of the Premises with serious crime or serious disorder.
The course will involve a detailed examination of the relevant parts of the Licensing Act 2003, the procedures, the decision making processes and the possible outcomes and consequences. Both Standard and Expedited reviews will be considered, together with all relevant case law.
It is vital that legal advisors are fully conversant with the legislation and the processes, as it is complex and there is a wealth of case law. This is also an area where there is an increased expectation that the Premises Licence Holder will be legally represented.
The detail will be set against a case study to illustrate the significant points of law and procedure and to promote discussion. This will be provided in advance to enable delegates to prepare.
This course is suitable for practitioners with some experience of licensing work and those involved in advising the licensing function and the Committee.
