The Regulator of Social Housing has withdrawn its decision to de-register a housing association from the register of social housing providers, following a High Court challenge.

In June this year RSH decided to de-register Pivotal Housing Association, a small provider of supported accommodation through leases mainly in the West Country, over its failure to meet the Governance and Financial Viability Standard and the Rent Standard.

The RSH had previously issued a regulatory notice about Pivotal in 2021, an enforcement notice in April 2025 and a regulatory judgement in January 2026.

On the decision in June RSH chief executive Jonathan Walters said: “Removal from the register is not an action we take lightly, however, Pivotal was not able to resolve very serious failures and did not respond adequately to enforcement action.”

However, in an update to the June regulatory judgement published today (20 October), the RSH noted that an appeal to the High Court under section 121 of the Housing and Regeneration Act 2008 (the Act) had been lodged.

“The Regulator decided on 6 October 2026 to withdraw the Decision, and the matter is under review. Accordingly Pivotal Housing Association will remain on the register,” it said.

A spokesperson for the RSH said it was "unable to comment further while this case is ongoing”.

Pivotal Housing Association has been approached for comment.
