Bromley Council has successfully prosecuted supermarket giant Tesco after one of its stores failed to comply with a planning condition that specified it could only make deliveries via a certain road.

Tesco Stores Ltd pleaded guilty at Bromley Magistrates' Court on 3 December 2024 to five charges for failing to comply with the council's planning enforcement notice.

The court ordered Tesco to pay £22,266 in fines and costs.

According to the council, the planning condition was designed to minimise disturbance for local residents.

However, the London borough claimed the store "seemingly ignored" the condition, leading it to issue an enforcement notice.

Deliveries reportedly continued to be made in breach of the enforcement notice on at least five occasions, occurring between November 2023 and March 2024.

Cllr Angela Page, executive councillor for public protection and enforcement said: "It is important that, when planning conditions are granted as part of a planning permission, they are properly followed.

"Planning conditions are often included to help control the development for the benefit of all.

"In this case, the planning condition has been designed to minimise impact on nearby local residents."

A Tesco Spokesperson said: “We have reviewed the approach to making deliveries to our Express on Stone Park Avenue and apologise for the inconvenience caused by these previous deliveries.”
