Stephanie Hall looks at a recent Court of Appeal judgment which concerns whether paragraph 90 of the NPPF means what it says when it suggests that permission “should be refused” for development having a significant adverse impact on a retail centre.
Stephanie Hall acted in the Appeal, Asda Stores v Leeds City Council [2021] EWCA Civ 32, for the successful Respondent. According to Hall, the decision has wider implications for how to approach all strongly worded policies in the NPPF and development plans which suggest an outcome for the overall application.
