The Law Society has issued a practice note on contaminated land for all solicitors involved in property transactions.
The practice note covers:
- Introduction: who should read the note; what the issue is; professional conduct; the status of the note; terminology;
- Contaminated land: the contaminated land regime; radioactive contaminated land; liability for remediation of contaminated land;
- Conveyancing transatctions: steps to be taken when acting for the buyer, tenant or lender; steps to be taken when acting for the seller or landlord; remediation notices; unresolved contamination;
