39 Essex Chambers expands property team with arrival of KC and established junior

Kerry Bretherton KC and Rebecca Cattermole have joined the Planning, Environment and Property Team at 39 Essex Chambers with immediate effect.

The set said it had expanded the team in response to increased demand and to enable it to meet the needs of its clients.

Bretherton has acted in the Supreme Court and Court of Appeal in a number of leading property cases.

39 Essex said she litigates and advises in all aspects of property, and property development and commercial disputes often arising out of development or property transactions as well as associated professional negligence. “Typically, her work involves high value and complex disputes.”

The set added that Bretherton frequently undertakes work in the following areas: options and overage, restrictive covenants, freehold covenants, easements, agricultural, conveyancing disputes, construction and building safety, conveyancing disputes and L&T.

Rebecca Cattermole is meanwhile an established and well-known junior in property and agricultural work, 39 Essex Chambers said.

“As well as the full range of landlord and tenant matters, Rebecca’s practice covers restrictive and freehold covenants, easements, nuisance, and complex issues surrounding the recovery and development of land,” the set added.

Cattermole has appeared in the Supreme Court, Court of Appeal and High Court in a number of important cases including the first appellate case in England and Wales on the availability of equitable set-off to defeat a notice to quit under the Agricultural Holdings Act 1986.

Lindsay Scott, Chief Executive of 39 Essex Chambers, said: “It is a very exciting time for Chambers. We are delighted Kerry and Rebecca have joined us, helping us to further bolster our property team.”

Kerry Bretherton KC said: “I am so excited to join the amazing team at 39 Essex Chambers.  The support and facilities are excellent, the clerking team are fantastic and it is wonderful to be working with such talented colleagues.  39 Essex Chambers are a force to be reckoned with and with such talented colleagues I expect the property team to be top ranked in the directories for real estate litigation very soon!”

Cattermole added: “I am thrilled to have joined 39 Essex Chambers.  This presents some very exciting opportunities and I am grateful to the support and enthusiasm from the team and members.”
