The Commons Registration Act 1965 and its successor, the Commons Act 2006 have proved difficult of interpretation in its application to village greens. Lancashire/Surrey is the seventh case to go to the House of Lords on the subject. In all these cases, at least one member of Francis Taylor Building has been involved. In Lancashire/Surrey, Douglas Edwards QC, Jeremy Pike, Daisy Noble and Ned Westaway all appeared; all will be at the seminar. The case is particularly interesting because of the division, forcefully expressed, which it produced among the Supreme Court Justices; because it left open questions about the scope of statutory incompatibility; and because it opened up the possibility of applications for deregistration of local authority land.
