 This course explores the key elements of the law and practice relating to statutory nuisance offences concerning noise and pollution, and the provisions of the Noise Act 1996 and the Environmental Protection Act 1990. It will cover civil and criminal jurisdiction in the magistrates’ court, prosecutions relating to the offence of failing to comply with an abatement notice, civil appeals in the magistrates’, and the grounds for appeal. The course will provide a thorough understanding of the practice and procedure relating to the enforcement and prosecution of notices relating to statutory nuisance, as well as a sound knowledge of preparing for and dealing with a case in the magistrates’ court.

This course is ideal for those who are new to local authority prosecutions work and anyone looking to improve their understanding of how best to prepare for a prosecution relating to statutory nuisance.

The course will cover:

  • Legislation and evidence including disclosure; witness evidence; and the provisions of PACE.
  • Preparation for a prosecution including the CPS two-fold test; summons/information; the provisions of the Criminal Procedure Rules and Practice Directions; offences and defences.
  • The magistrates’ court hearing including the relevant legislative provisions; preparation for different categories of offence; case study; and out of court disposals
  • Advocacy including sentencing guidelines; costs applications; case presentation; and advocacy best practice.
  • Magistrates’ court appeals.
