John de Waal QC, John Clargo, Jamal Demachkie and David Peachey will be discussing three aspects of the law on rights of way, which often lead to confusion:

  • The interrelation between rights to park and rights of way;
  • Intensification of use by the dominant tenement, both in cases of express grant and prescription;
  • Access to land beyond the dominant tenement, and the issue in Harris v Flower & Sons
