Join us for LLG's next meeting in its National Lead programme for 2021 where on the day we will be joined by Mike O'Brien from No.5 Chambers where he will look at The impact of the new guidance on section 21A applications in the Court of Protection in relation to case of DP v LB Hillingdon [2020]

The Court of Appeal has used the case of DP v LB Hillingdon [2020] to set out new guidance on how local authorities and others should deal with section 21A applications. This has significant implications for the way in which local authorities deal with applications where the mental capacity of a person is disputed. Mike O'Brien QC regularly appears in the Court of Protection and today he will set out the practical implications of the new guidance and caselaw for local authorities and answer questions.
