Campaigners net permission to take demolition case to Court of Appeal

The Court of Appeal has earlier this month given campaign group SAVE Britain’s Heritage permission to bring a challenge against the demolition of more than 10 historic buildings on Lime Street in central Liverpool.


SAVE Britain’s Heritage is seeking to challenge on heritage grounds a decision by Liverpool City Council to grant planning permission for the demolition.

Developers plan to build student flats, shops and commercial premises on the site as part of a £35m regeneration project.

Mrs Justice Patterson rejected SAVE Britain’s Heritage’s claim in the High Court but the charity has now been granted permission by Lord Justice Lindblom in the Court of Appeal.

The judge said:
 
“I accept the appeal has a real prospect of success, and in any event that matters raised on the interpretation and application of the guidance … are important enough to afford a compelling reason for the appeal to be heard."

Henrietta Billings, Director of SAVE Britain’s Heritage, said: “This permission to proceed with the appeal is great news. We are looking forward to scrutinising and challenging the decision to destroy this important terrace of 18th and 19th century buildings, as well as the Futurist cinema, at the Court of Appeal.”


The campaign group has been seeking to crowd fund the legal action. So far it has raised nearly £4,000 towards its £10,000 target.
