Developer ordered to pay £50k+ over demolition of pub

A property developer has been fined £32,000 for demolishing a pub in a prosecution brought by East Riding of Yorkshire Council, it has been reported.

Wayne Low must also pay the council £21,968 in costs, according to Hull Live.

Mr Low admitted at Hull Crown Court to failing to obtain planning permission to demolish the 200-year old Travellers Rest pub in a conservation area in Long Riston.

The demolition work came to light on 28 November 2019 when a power company was asked to disconnect supplies and local residents complained the same day.

In January 2020 demolition was still in progress and Mr Low was warned he was committing an offence and should stop the work.

The council took enforcement action, requiring Mr Low to rebuild the pub, and a notice was issued on 11 December 2020 against which Mr Low unsuccessfully appealed.

Lawyers for the council told the court: "The building is not finished, either in part or in full. It's still subject to complaints. It has not been rebuilt to the standard that was required. It has not been reconstructed in accordance with the plans.”

According to Hull Live, Recorder Tahir Khan QC told Mr Low he had been warned demolition was a criminal offence.

He said: ”You could not have been under any illusion that continuation with the demolition project would most likely land you in serious trouble but, despite the warning, you carried on with demolition.

“This was a deliberate and blatant disregard of the law in the knowledge that what you were doing was committing harm to a heritage asset.”

Alan Menzies, East Riding of Yorkshire’s director of planning, said: "We are pleased the court has taken the breaches seriously which is reflected in the fine handed down.

“I hope this case serves as a warning to anyone who does not abide by planning regulations that we will enforce the law and prosecute if necessary.”
