Legal challenge to planning permission for £10m stadium rejected

A legal challenge to a development due to part-fund the Stadium for Cornwall project has failed.

Developer Helical Retail, which plans a retail redevelopment in Truro, had objected to Cornwall Council’s grant of planning permission for a retail project at nearby West Langarth.

Income from the latter is due to support construction of the £10m stadium.

Planning permission was given in July for West Langarth to developers Inox Group and Henry Boot Developments.

Helical Retail, which has been contacted for comment, argued that it would be too close to its own proposed retail centre.

It is understood that permission to appeal was refused on the papers and the time for requesting the decision to be reconsidered at a hearing has passed.

Inox managing director Rob Saltmarsh said: “The decision by the court to dismiss the judicial review application made by Helical Retail…clearly demonstrates that the application was without foundation and substance, and in our opinion purely commercially motivated.”

The Stadium for Cornwall will be a multi-use sports and education facility and a permanent home for the Cornish Pirates rugby team.

It will also house Truro & Penwith College’s business centre and its sport and hospitality teaching facilities,
