Council hit with judicial review challenge after calling on man housed under 'Everyone In' Scheme to leave hotel

Lawyers to a Bangladeshi national with leave to remain in the UK but with no recourse to public funds have secured an interim relief order requiring Tower Hamlets Council to continue to accommodate him pending a decision on permission to proceed with a judicial review claim.

Mohammed Bhuiyan had been housed by the London borough in March 2020 as part of the ‘Everyone In’ Scheme which required councils to provide emergency housing for rough sleepers during the pandemic.

Mr Bhuiyan received a letter from Tower Hamlets on 22 June 2021 requiring him to leave the hotel by 2 August.

His lawyers said that this was despite the Ministry of Housing, Community and Local Government stating that the Scheme was “ongoing” and that “no one should find themselves back on the street”,
