An Englishperson’s home is their castle, or so the saying goes. Understandably, any attempts to make that castle smaller is going to cause the taking up of arms! Interference with one’s property comes in many forms, but nothing screams betrayal more than that interference coming from your neighbour. The reality is that some of the most bitter disputes are between neighbours, and, in particular the boundary between their properties. The smallest action (e.g., moving a fence post by 5cm) can easily spiral into years of complex and costly litigation. Too often litigants turn to HM Land Registry, claiming that the title plan puts an end to the debate, and this is almost always not the case. Litigators therefore need to be aware of the law, procedure and evidence necessary to tackle these difficult disputes.
