Cornwall to defend judicial review challenge over St Ives neighbourhood plan

Cornwall Council has said it will fully defend a judicial challenge to its decision to support publication of the St Ives Neighbourhood Plan and put it to a referendum.

The neighbourhood plan was passed this week (5 May) by an 83% majority. Voter turnout was 47.2%.

The plan proposed – amongst other measures – that new open market housing, excluding replacement dwellings, would only be supported where there was a restriction to ensure its occupancy as a principal residence.

Cornwall Council confirmed that it had received notice that RLT Built Environment Limited was seeking permission for a judicial review.

In a statement the local authority said: “Following the positive result of the referendum we will be carefully considering the grounds on which the claim for the judicial review has been made and seeking further legal advice if required. We are confident that the correct process has been followed in this case and will be fully defending this claim.”
