Woman jailed for series of breaches of injunction including "shouting, screaming" during sex

A Birmingham woman was earlier this month sentenced to an immediate custodial sentence of 14 days for contempt of court after breaching an interim injunction on a number of occasions, including by screaming and shouting whilst having sex late at night.

Sitting at the Birmingham Civil Justice Centre on 12 May, District Judge Emma Kelly found that Gemma Wale had committed six breaches of an interim injunction order dated 20 January 2015 to which she was subject.

The basis of the imposition of that sentence was that the defendant:

  1. On 27 January 2015 at 22:20 hrs caused nuisance and annoyance by arguing in breach of paragraph 3 of the order.
  2. On 29 January 2015 at approximately 01:50 hrs caused nuisance and annoyance by screaming, shouting whilst having sex in breach of paragraph 3 of the order.
  3. On 29 January 2015 at 16:45 hrs caused nuisance and annoyance and also intimidated and harassed [another person] by shouting “look she’s looking the f*cking bitch” in breach of paragraphs 1 and 3 of the order.
  4. On 1 February 2015 at 11:10 p.m. until 07:30 hrs caused nuisance and annoyance by banging, fighting, running around in breach of paragraph 3 of the order.
  5. On 6 February 2015 caused nuisance and annoyance by running around in breach of paragraph 3 of the order.
  6. On 9 February 2015 at 04:57 hrs the defendant caused nuisance and annoyance by banging on the walls and running around. At 12:25 hrs [she] banged on the walls at 04:45 and caused nuisance and annoyance by setting the fire alarm off twice in breach of paragraph 3 of the order.
