Building owner to pay £40k+ after failure to comply with enforcement notice

A building owner must pay more than £40,000 as part of a crackdown by Royal Borough of Kensington & Chelsea planning enforcement officers in some of London’s most exclusive areas.

Mayur Naturbhai Patel extended his property in Portland Road, Holland Park, without planning consent.

He was fined £15,000 at Isleworth Crown Court and had £25,350 confiscated under the Proceeds of Crime Act for failing to comply with an enforcement notice in relation to an unauthorised roof terrace, and was also ordered to pay the council's costs of £3,580.

Patel will face 15 months in prison if he fails to pay the confiscation order within three months, the council said.

Planning enforcement officers served a further five enforcement notices during June.

Tim Coleridge, cabinet member for planning at Kensington & Chelsea, said: “Owners and developers must respect planning law and they must respect their neighbours,

“There is nothing optional about it, as a number of people in Kensington and Chelsea have recently found out.”
